PUBLIC RECORD REQUEST FORM

In accordance with the Kansas Open Records Act (KORA), it is the public policy of the Shawnee Mission School District (SMSD) that public records shall be open for inspection unless disclosure of such records is exempt or otherwise protected by law.

Public records are defined as “any recorded information, regardless of form or characteristics, which is made, maintained, kept by, or is in the possession of any public agency” (K.S.A. § 45-217(g)). Records that do not exist are not subject to KORA, nor does KORA require a public agency to create a record in response to a request or answer questions seeking general information (A.G. Opinion No. 98-51).

This form must be completed by any person requesting access to public records. Requests for access to public records will be acted upon no later than the end of the third business day following receipt of the request. If access cannot be granted within three business days, the custodian of records will provide an explanation for the delay and identify the date, time, and place at which the records will be made available.

KORA recognizes that certain records contain confidential or private information. Accordingly, the Act provides several exceptions to disclosure. A list of exceptions may be found at K.S.A. § 45-221.

The District reserves the right to request proof of identity when necessary to comply with applicable confidentiality laws, protect privacy interests, or verify that records may be lawfully disclosed to the requester.

KORA also authorizes public agencies to charge reasonable fees for providing access to or furnishing copies of public records. SMSD may require payment of estimated fees in advance. Such fees may include:

  • Staff time required to locate and retrieve records;
  • Staff time to review and redact closed and/or confidential information from records; and
  • Costs associated with copying, scanning, or reproducing records.

Certification

I acknowledge that I am aware of the provisions of K.S.A. § 45-230(a), which states:
“No person shall knowingly sell, give, or receive, for the purpose of selling or offering for sale any property or service to persons listed therein, any list of names and addresses contained in or derived from public records . . . .”

Violation of this statute may subject the violator to a civil penalty of up to $500 for each violation.
